This Privacy Policy (“Policy”) applies to your (“you” or “User”) access and use of the ServicePro application (“Application”) and the services and products ordered through the Application (“Services”).

Async Technologies Ltd, trading aka Tirecheck, a limited liability company incorporated and existing under the laws of Republic of Ireland, whose registered office is at 23 Information Age Park, Ennis, County Clare, Republic of Ireland, Company ID No: 395132 is the controller and is responsible for your personal data (“we”, “us”, “our” or “Controller”). This Policy applies to you if you have downloaded the Application and are accessing and using the Application and the Services:

a)    on your own. In such case, you are accessing and using the Application and the Services based on the contract you have entered with us by agreeing to the Terms and Conditions;

b)    following instructions of your employer or your business partner. In such case, your employer or your business partner has entered into a contract with us and authorized you to use the Application and the Services. By accessing and using the Application and the Services you have agreed to the Terms and Conditions.

This Policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our practices regarding your personal data and how we will treat it.

This Policy sets out, in particular: (i) what information we collect about, (ii) how we collect that information, (iii) how we use that information, (iv) how we process that information, (v) to whom we disclose that information, (vi) how we protect that information and (vii) what are your rights and how can you exercise them.

WHAT PERSONAL DATA DO WE COLLECT?

Personal data may be freely provided by you, or by your employer or your business partner on who’s instructions you are accessing and using the Application and the Services, or, in case of usage data, personal data is collected through using the Services and/or the Application. Collection of some personal data is necessary for the availability or the correct functioning of the Services and/or the Application.

 

Information you, your employer, or your business partner provides directly to us

We collect information about you when you, your employer or your business partner register(s) user account and/or licensed user profiles, create(s) and/or modify(ies) your account or profile and add(s) vehicle information. This information includes:

  • User Identification (such as username, email, first name, last name, address, phone number, order information);
  • Vehicle information (such as registration number, manufacturer, mileage, type of vehicle);
  • Location (such as location of service centre, to which the vehicle is assigned);
  • User’s customer information (such as name of the company, address)
  • Stock information (such as stock levels of sensors, etc.)
  • Technical information (such as tire manufacturer, tire tread, pressures, tire location, equipment specifiacation etc).

 

Information you provide to us when you use the Services and/or Application

We also collect information through your use of the Services and/or Application. Such Application usage information includes actions such as logging into your user account or licensed user profile and using it, device type, internet service provider, IP address, date/time of visit information, operating system, and other usage data.

HOW WE USE PERSONAL DATA?

 

We may use the personal data for the following purposes:

User Account and Licensed User Registration

In order to access and use the Application and Services, you must register and create a user account and you may authorize licensed users. For this purpose, the following applies:

  • Personal data processed: User Identification.
  • Legal basis for processing: The processing is necessary for the performance of a contract you conclude with us when you register a user account and authorize licensed users, or in connection with a performance of such contracts your employer or your business partner has concluded with us.
  • Retention time: We process your personal data during the time you have a user account and/or licensed user profile until deletion of the profile / user account. .

 

Providing the Services and the Application

Some personal data are necessary for the provision of Services you intend to use and for the functioning of the Application. For this purpose, the following applies:

  • Personal data processed: Vehicle information, Location information, User’s customer information, Stock information, Technical information.
  • Legal basis for processing: The processing is necessary for the performance of a contract you concluded with us when you register a user account and order Services, or in connection with a performance of such contracts, your employer or your business partner has concluded with us.
  • Retention time: We process the personal information during the time you use the Application and during the provision of the Services.

 

Analytics

We gather information about your access and use of the Application and the Services in order to analyse customer behaviour and to improve the Application and the Services. For this purpose, the following applies:

  • Personal data processed: User Information, Application Usage Data.
  • Legal basis for processing: The processing is necessary for the purpose of our legitimate interest in improving the Application and the Services.
  • Retention time: We process your Personal Data for a maximum of two years after your last use of the Application and/or Services. After this period, we process the information only in an aggregated and anonymized form.

 

Customer Support

We process your personal data in order to answer your questions and provide you with customer support. This processing occurs when you contact us via email, through the Application or otherwise. For this purpose, the following applies:

  • Personal data processed: User identification, Application Usage Data.
  • Legal basis for processing: The processing is necessary for the purpose of our legitimate interest in maintaining customer satisfaction.
  • Retention time: We process your Personal Data until your request is settled.

 

Protection against legal claims

 

If you used the Application or the Services, we may retain personal data in order to prove that we have complied with all legal obligations and that we have not infringed the rights of third parties. For this purpose, the following applies:

  • Personal data processed: User identification, Vehicle information, Location information, User’s customer information, Stock information, Technical information.
  • Legal basis for processing: The processing is necessary for the purpose of our legitimate interest in our protection against legal claims.
  • Retention time: We keep your personal data for two years from the date on which the previous reason for processing such data ceases to exist.

HOW DO WE PROCESS PERSONAL DATA?

 

The personal data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. No automated individual decision making that would produce legal effects concerning you or similarly significantly affect you takes places during the processing of your personal data.

TO WHOM DO WE DISCLOSE YOUR INFORMATION?

Your personal data are disclosed to your employer or other owner of the user account or licensed user profile under which you use the Application or the Services.  For information on data processing by your employer or your business partner, please contact them directly.

We disclose the personal data to companies in our group, i.e. to our parents, subsidiaries or affiliates, in particular to TIRECHECK s.r.o., a limited liability company incorporated and existing under the laws of the Czech Republic, whose registered office is Jindřišská 937/16, Nové Město, 110 00 Praha 1, Czech Republic, identification number 031 04 915, registered in the Commercial Register maintained by the Municipal Court in Prague, file no. C 227554.

The personal data may be in some cases accessible to certain types of persons in charge, involved in the operation of the Application and the Services (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as data processors by us. If required by law, we have concluded Data Processing Agreements with these external third parties. These agreements bind the external third parties, among other things, to process the personal data only in accordance with our instructions and in compliance with data protection laws, and to take all necessary measures to protect the personal data. These entities are not allowed to use your information for purposes other than providing services for us.

Although we do not disclose personal data to third parties as described above, you acknowledge that some of provided data in its aggregated and anonymized form will be disclosed to other entities.

DO WE TRANSFER PERSONAL DATA TO THIRD COUNTRIES OR INTERNATIONAL ORGANISATIONS?

We do not transfer your personal data to third countries or international organizations.

WHAT WE DO TO KEEP YOUR PERSONAL DATA SECURE?

In order to ensure the protection from unauthorised access or alteration, disclosure or destruction of information we collect and process, we have adopted among other things organisational and technical measures consisting of physical, electronic and managerial procedures to safeguard and secure the information we collect about you through this Website. Please note that the security of your Personal Data depends also on your own behaviour. The security of your Personal Data may be compromised as a result of transferring or handling your log-in information or other personal data by you in an unsecure way.

WHAT ARE YOUR RIGHTS?

 

You may exercise certain rights regarding your personal data processed by us as the data controller:

  • Access your personal data. You have the right to learn if your personal data is being processed by us, obtain disclosure regarding certain aspects of the processing and obtain a copy of the personal data undergoing processing.
  • Verify and seek rectification. You have the right to verify the accuracy of your personal data and ask for an update or correction
  • Have your personal data deleted or otherwise removed. You have the right, under certain circumstances, to obtain the erasure of your personal data from us. This right applies for example when you withdraw your consent or when the personal data is no longer necessary in relation to the purposes for which they were collected or otherwise processed.
  • Restrict the processing of your personal data: You have the right, under certain circumstances, to restrict the processing of your personal data. This right applies for example when you contest the accuracy of the personal data or when the processing is unlawful.
  • Receive your personal data and have it transferred to another controller: You have the right to receive your personal data in a structured, commonly used and machine-readable format and, if technically feasible, to have it transmitted to another controller without any hindrance. This provision is applicable provided that the personal data is processed by automated means and that the processing is based on your consent, on a contract which you are a part of or on pre-contractual obligations thereof.
  • Object to processing of your personal data: You have the right to object to the processing of your personal data if the processing is carried out on a legal basis other than consent. Where your personal data is processed for the purposes of the legitimate interests pursued by us, you may object to such processing by providing a ground related to the particular situation to justify the objection. If we do not demonstrate compelling legitimate grounds for the processing, which override your interests, rights and freedoms, or for the establishment, exercise or defence of legal claims, we will no longer process the personal data.
